These Terms of Service govern your access to www.vesperrouge.com, your use of the website, and your purchase of products from Vesper Rouge.
By browsing the website, placing an order, making payment, contacting us, or using any Vesper Rouge service, you agree to these Terms of Service.
1. Definitions
In these Terms of Service, "Vesper Rouge", "we", "us", and "our" refer to the Vesper Rouge brand, website, products, customer support, and sales operations. "Customer", "you", and "your" refer to any person who visits the website, places an order, communicates with us, or purchases a product.
2. Eligibility
You must be legally competent to enter into a binding contract under applicable law to use the website or place an order.
If you place an order on behalf of another person or entity, you confirm that you are authorised to do so and that the information provided is accurate.
3. Nature of Products
Vesper Rouge offers luxury apparel, including bespoke, made-to-order, limited-run, and order-specific garments.
Many pieces may involve manufacturing, finishing, sourcing, inspection, packing, or preparation after order confirmation. You acknowledge that production or order-specific work may begin almost immediately after the order is placed.
4. Product Information and Visual Representation
We make reasonable efforts to display product information accurately, including product photographs, colour, fabric, fit, silhouette, sizing, price, and description.
However, slight variations may occur due to lighting, screen settings, fabric batch differences, handmade finishing, natural fabric behaviour, minor measurement tolerance, model body type, styling, and photography.
Reasonable variation in colour, texture, drape, measurement, or finish shall not automatically be treated as a defect.
5. Size, Fit, and Customer Responsibility
The customer is responsible for reviewing the size guide, garment measurements, fit notes, product description, and care information before placing an order.
If you are unsure about size, fit, fabric, length, or suitability, you should contact Vesper Rouge before placing the order.
Incorrect size selection, incorrect address, wrong contact details, or failure to review product information may affect delivery, return, refund, or exchange eligibility.
6. Order Placement and Acceptance
An order is placed when the customer completes checkout and makes payment through an accepted payment method.
Order confirmation may be sent by email, SMS, WhatsApp, website account, or another communication channel. Order confirmation does not prevent Vesper Rouge from cancelling or rejecting an order before dispatch for genuine operational, payment, fraud prevention, product availability, pricing error, or legal reasons.
7. Pricing and Payment
Prices are displayed on the website or communicated through authorised Vesper Rouge channels.
Vesper Rouge may correct obvious pricing errors, technical errors, or listing errors. If an order is affected by an obvious pricing error, Vesper Rouge may cancel the order and process an eligible refund.
Payments are processed through authorised payment methods. Vesper Rouge shall not be responsible for payment gateway downtime, bank failure, card decline, UPI error, wallet failure, chargeback delay, currency conversion issue, or third-party payment processor error.
8. Taxes, Invoices, and Billing Records
Taxes, invoices, receipts, credit notes, refund records, payment reconciliation, and statutory accounting records may be issued, maintained, or processed under the applicable billing or tax entity for Vesper Rouge, including DAYS Group Of Companies where applicable.
The customer-facing brand remains Vesper Rouge. The appearance of DAYS Group Of Companies on invoices, payment descriptors, tax records, accounting records, credit notes, or billing communication does not alter the customer-facing product relationship with Vesper Rouge.
9. Shipping
Domestic shipping within India is free unless otherwise stated.
International shipping will incur an additional fee of US$ 20 unless otherwise stated at checkout or confirmed in writing.
Domestic orders are usually delivered within 1 week to 10 days. International orders are usually delivered within 14 to 21 days. Timelines are estimates and may be affected by production, quality checks, courier delays, customs, holidays, address issues, or force majeure.
Shipping is governed in detail by the Shipping Policy.
10. No Cancellation After Order Placement
Cancellations are not allowed once an order is placed.
This is because Vesper Rouge pieces may be bespoke, made-to-order, limited-run, or order-specific, and manufacturing, sourcing, finishing, quality checking, or preparation may begin almost immediately after order placement.
By placing an order, you acknowledge and agree that cancellation after order placement is not allowed unless Vesper Rouge expressly approves it in writing or cancellation is required by applicable law.
11. Returns and Refunds
Returns and refunds are governed by the Return and Refund Policy.
A return may be accepted only if the garment is unused, unworn except for careful trial, unwashed, unaltered, undamaged, with labels and tags intact, with original packaging intact, and in resaleable condition.
Refunds for approved returns are processed within 7 days of receiving the product back at the Vesper Rouge facility and completing quality inspection.
12. International Orders
International customers are responsible for customs duties, import taxes, local levies, customs clearance charges, currency conversion charges, bank charges, destination-country charges, and similar costs.
For international returns, the customer must ship the approved return back to Vesper Rouge at the customer own cost using a reliable, trackable courier service.
13. Customer Communication
You agree to provide accurate contact details and remain reachable for order, delivery, payment, return, refund, or support communication.
Vesper Rouge may communicate by email, phone, SMS, WhatsApp, website account, or other practical channels connected with your order or enquiry.
14. Intellectual Property
All content on the website, including the brand name, product names, photographs, garment designs, campaign images, descriptions, graphics, website layout, styling, and visual presentation, belongs to Vesper Rouge or its licensors unless otherwise stated.
You may not copy, reproduce, modify, publish, imitate, distribute, commercially exploit, or use Vesper Rouge content without prior written permission.
15. Prohibited Use
You agree not to misuse the website, interfere with website security, provide false information, commit fraud, scrape content, copy designs, upload malicious code, abuse staff, make false claims, or use the website in violation of applicable law.
16. Limitation of Liability
To the maximum extent permitted by law, Vesper Rouge shall not be liable for indirect loss, consequential loss, loss of profit, courier delay, customs delay, payment gateway failure, incorrect customer information, failed delivery, incorrect size selection, colour variation due to display settings, minor fabric tolerance, or circumstances beyond reasonable control.
Where liability is legally established, Vesper Rouge total liability shall not exceed the amount paid by the customer for the specific product giving rise to the claim, unless applicable law requires otherwise.
17. Indemnity
You agree to indemnify and hold harmless Vesper Rouge, its owners, employees, representatives, vendors, and service providers from claims, losses, damages, costs, or liabilities arising from your breach of these Terms, misuse of the website, false information, fraudulent conduct, violation of law, or violation of third-party rights.
18. Force Majeure
Vesper Rouge shall not be liable for failure or delay caused by events beyond its reasonable control, including natural disasters, fire, flood, pandemic, war, civil unrest, government action, import or export restrictions, customs delay, courier disruption, labour disruption, internet failure, payment gateway failure, power failure, or raw material shortage.
19. Changes to These Terms
Vesper Rouge may update these Terms of Service from time to time. Updated Terms will be posted on the website with the revised effective date. Continued use of the website after updates are posted means that you agree to the updated Terms.
20. Governing Law and Jurisdiction
These Terms of Service shall be governed by the laws of India.
Subject to applicable law, any dispute arising out of or in connection with the website, products, orders, payments, shipping, returns, refunds, or these Terms shall be subject to the exclusive jurisdiction of the competent courts at Chennai, Tamil Nadu, India.
